1 Purpose
This Acceptable Use Policy ("AUP") governs how you may use the Pocket Agent platform and services operated by Fix IT Technologies, LLC. By using the Service, you agree to comply with this AUP in addition to our Terms of Service.
Pocket Agent is designed for legitimate personal and business communication use cases. The following rules protect the integrity of our platform, the safety of individuals who interact with your agent, and compliance with applicable telecommunications law.
2 Permitted Uses
The following are examples of legitimate, permitted uses of the Service:
- Personal AI assistant for managing inbound SMS communications
- Business customer service agent responding to opted-in customers
- Appointment reminders and scheduling for existing customers who have opted in
- Internal team communication and automation tools
- Information delivery services where recipients have provided explicit consent
- Follow-up communications with leads who have requested contact
3 Prohibited Activities
The following activities are strictly prohibited. Violations will result in immediate account suspension.
Messaging Abuse
- Sending spam, unsolicited bulk messages, or mass outbound campaigns to recipients who have not explicitly opted in
- Automated outbound marketing campaigns without verifiable prior consent from each recipient
- Purchasing, renting, or using third-party lists for outbound messaging
- Sending the same or substantially similar messages to large numbers of recipients (bulk blasting)
- Circumventing platform rate limits, message caps, or quiet hours restrictions
Harmful & Illegal Content
- Transmitting, distributing, or facilitating content that is illegal under any applicable US federal or state law
- Harassment, threats, intimidation, or abuse directed at any individual
- Content that promotes violence, self-harm, or illegal activity
- Fraud, phishing, or deceptive communications designed to mislead recipients
- Child sexual abuse material (CSAM) — we are legally required to report all such content to the National Center for Missing & Exploited Children (NCMEC) and appropriate law enforcement
Identity & Access
- Impersonating any real person, business, government entity, or brand without authorization
- Using your agent to misrepresent its AI nature when directly and sincerely asked by a recipient
- Sharing account credentials or agent access with unauthorized users outside your organization
- Using the Service to gain unauthorized access to third-party systems or data
Platform Abuse
- Attempting to reverse-engineer, scrape, or extract proprietary data from the platform
- Automated access to platform APIs in ways not expressly authorized
- Using the Service to facilitate use by unauthorized third parties (reselling without authorization)
- Any activity that degrades platform performance or stability for other users
4 Fair Use & Message Limits
Soft Cap: Each subscription includes a fair use allowance of 1,500 messages per month. This is a soft limit — not a hard cutoff.
- Usage between 1,000–1,500 messages/month is considered standard fair use
- Usage consistently above 1,500 messages/month may result in rate throttling during peak periods
- Sustained high-volume usage may trigger an account review and possible upgrade to a higher-tier plan
- We will contact you before taking any action related to usage levels
5 Enforcement
Violations of this AUP may result in:
- Immediate suspension of your account without prior notice
- Permanent termination of your account and forfeiture of any prepaid subscription fees
- Reporting to applicable law enforcement or regulatory authorities
- Legal action, including seeking injunctive relief or damages
We reserve the right to investigate any reported or suspected violation. During an investigation, your account may be temporarily suspended with access restored if no violation is found.
6 Reporting Violations
If you become aware of any misuse of the Pocket Agent platform — including spam, harassment, or illegal content — please report it to us immediately:

- Include as much detail as possible: phone number involved, message content, date/time
- CSAM reports are handled with highest priority and reported to NCMEC as required by law
7 Updates to This Policy
We may update this Acceptable Use Policy as the platform evolves and as telecommunications regulations change. Material changes will be communicated via email at least 14 days before taking effect. Continued use of the Service constitutes acceptance.
