These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Fix IT Technologies, LLC, a Nevada limited liability company ("Company," "we," "us," or "our"), governing your access to and use of the Pocket Agent platform and related services (collectively, the "Service").
By creating an account, subscribing to the Service, or otherwise accessing any part of the platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use the Service.
Pocket Agent provides AI-powered SMS and voice agent services for personal and business use. The Service enables you to configure, deploy, and manage intelligent agents that communicate via SMS text messaging and voice calls using phone numbers provisioned on your behalf through Twilio.

The Service is available exclusively to customers located in the United States of America. By using the Service, you represent and warrant that:
We reserve the right to terminate accounts that do not meet these requirements or that provide false location information.
Access to the Service requires a paid subscription. Subscriptions are billed on a monthly recurring basis via Stripe, our third-party payment processor. By providing your payment information, you authorize us to charge your payment method on a recurring monthly basis.
We reserve the right to modify subscription pricing with at least 30 days' advance notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
The Service operates under a fair use policy to ensure platform stability and quality for all customers. Your subscription includes a soft cap of 1,500 messages per month.
This cap is a soft limit — we will not cut off service abruptly without notice. However, sustained excessive usage may result in a plan upgrade requirement.
As part of the Service, we provision Twilio phone numbers on your behalf. You understand and agree that:
Termination by You: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing cycle.
Termination by Us: We reserve the right to suspend or terminate your account immediately and without prior notice if:
Upon termination, your access to the Service ceases immediately. Conversation data may be retained for up to 30 days after termination before permanent deletion, unless you request earlier deletion.
Your Data: You retain full ownership of all content you input into the Service, including conversation histories, agent configurations, and any data generated through your use of the platform. We do not claim ownership over your data.
Our Platform: The Pocket Agent platform, including its software, design, algorithms, branding, and all underlying technology, is owned exclusively by Fix IT Technologies, LLC. Nothing in these Terms grants you any rights to our intellectual property beyond the limited license to use the Service during your active subscription.
You grant us a limited, non-exclusive license to process your data solely to provide the Service to you.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FIX IT TECHNOLOGIES, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
You agree to indemnify, defend, and hold harmless Fix IT Technologies, LLC, its members, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. AI-generated responses may be inaccurate, incomplete, or inappropriate — you are responsible for reviewing and overseeing your agent's interactions.
These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Clark County, Nevada.
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 14 days before taking effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
